LAW 406

International Commercial Arbitration

Cross-border commercial disputes rarely end up in national courts, parties pick arbitration instead, and this course is about the legal machinery that makes that choice work: how an arbitration agreement binds parties, how tribunals get jurisdiction, and how an award rendered in Paris actually gets enforced in Istanbul. You'll work through the ICC and UNCITRAL Rules alongside the New York Convention and Model Law, comparing Turkish, Swiss, French, and English approaches, with an exercise session on drafting clauses and a written midterm plus final. It's the practical capstone to your private international law and contracts sequence, and the one course that genuinely matters if you're heading into transactional or dispute-resolution practice.

The minimum attendance requirement is 10 out of 14 (complete) two-hour lectures (i.e. just above 70%) in order for a student to be admitted to the final exam. A knowledge of the fundamentals of the law of contract and procedure is a requirement. A knowledge of private international law is a considerable advantage to any student.
